These Terms permit you to use the Website for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Content on our Website, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

The Company is a privately-owned entity. We are not affiliated with, endorsed by, or sponsored by the U.S. Department of Veterans Affairs (VA), the Department of Defense (DoD), or any other U.S. government agency. The appearance of official VA forms (such as DBQs) or references to VA processes on this Website is for informational purposes only and does not imply such endorsement or affiliation.

8. No Guarantee of Results

The Company provides consultative services to assist you in the preparation and presentation of your claim for VA disability benefits. The Company makes no representation, warranty, or guarantee, express or implied, regarding the success, approval, rating percentage, or effective date of any VA claim. The decision on any claim is made solely by the VA at its discretion based on its own adjudication process, applicable laws, and regulations.

9. User Contributions

The Website may contain message boards, chat rooms, personal web pages or profiles, forums, bulletin boards, and other interactive features (collectively, "Interactive Services") that allow users to post, submit, publish, display, or transmit (hereinafter, "post") content or materials (collectively, "User Contributions") on or through the Website.

Any User Contribution you post to the site will be considered non-confidential and non-proprietary. All purchases for services through the Website or subsequent communications are subject to the Company's separate Professional Services Agreement, which you will be required to execute prior to the commencement of any paid services. By purchasing services, you agree to the terms of that agreement.

All fees for services are non-refundable once the Company has initiated work, including but not limited to the review of your records or the drafting of deliverables, as detailed in the Professional Services Agreement. The Company uses third-party payment processors (such as Stripe and PayPal) to bill you through a payment account linked to your purchase. The processing of payments will be subject to the terms, conditions, and privacy policies of those payment processors.

11. Privacy and Health Information

All information we collect on this Website is subject to our Privacy Policy. By using the Website, you consent to all actions taken by us with respect to your information in compliance with the Privacy Policy. When you engage our services and submit Protected Health Information ("PHI"), such information is protected in accordance with the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") and our Business Associate Agreements with contractors.

All matters relating to the Website and these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Wyoming without giving effect to any choice or conflict of law provision or rule (whether of the State of Wyoming or any other jurisdiction). Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of Wyoming, in each case located in the County of Sheridan. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

17. Limitation on Time to File Claims

Any cause of action or claim you may have arising out of or relating to these Terms or the Website must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently barred.

18. Waiver and Severability

No waiver by the Company of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

19. Entire Agreement

These Terms, our Privacy Policy, and the Professional Services Agreement (where applicable) constitute the sole and entire agreement between you and MAGLINC CONSULTANCY LLC regarding the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Website.
